I see walkem everyday and one morning my son left the side gate opened and my dog got loose and attacked him and his dogs around the corner from where i live? He gots 7000 in hospital bills and 500 in vet bills his lawyer is suing my homeowners for 40k what kind of factors will she go by?

  • If it is your homeowner's insurance, they will handle the court case, if any.

Just as a guess, they probably will be pursuing 7500 in actual damages (almost a sure thing). Pain and suffering can vary widely, generally about 2 to 4 times the actual damages. It looks like the lawyer is going for the reasonable maximum, probably for settlement purposes. Emotional distress the anxiety caused by the dog bite, and may potentially require psychological treatment. It would imply a particularly brutal attack by the dog.
